Bob the reasoning you made was that if X worked then there wouldn't be any torrent sites. It is so incredibly fallacious, and you know it.
Besides, who said ostracism would eliminate them completely?

Actually the servers in the u.s. had nothing to do with filesharing. which is why the case wont work. and yes its acted upon by an existing law but it is a retaliation for sopa being thrown out and is a bullying technique by large corporations to scare smaller business's into not starting because of fear. it is happening sopa or not

And yes, I said they would be effective, not that they would eliminate the issue completely. That is an impossible task. As for the facts, how on earth can you argue that ostracism and social pressures have done "nothing of the sort?" Baducci, seriously?

Considering his video made a million in 12 days online, with virtually no distribution costs relative to conventional methods, it shows how it is more than feasible to profit from ones creative endeavors without the gun of government preventing competition. In other words it completely obliterates the utilitarian argument previously used to justify ip laws, the same fallacious reasoning that lead the founding fathers to compromise and included it in the constitution.

I'm denying that I ever said that any remedy would remove ALL piracy sites. I simply said that if your solution worked piracy sites would be gone. I will concede that I should have specifically used the word "some" but I thought that was implied in my sentence.
In the words of Cool Hand Luke, "What we have here is a failure to communicate." The fact that the number of piracy sites is increasing rather than decreasing shows that, so far, no practical solutions have been yet been effectively implemented. I look to reasonably written laws to enforce what I see as the rights attached to intellectual property. You do not concede the existence of intellectual property, per se, so your proposed "solution" is essentially meaningless and toothless. We disagree, obviously. And with that, I think I've exhausted all I have to say on this thread. Thanks for the interesting discussion. Best- Bob |

There are mildly analogous laws with respect to physical property, e.g. the doctrine of adverse possession can relieve one of his or her real property after a certain amount of time if it's not in use.
The reason for the IP "limited time" provision is because the law is attempting to strike a balance between the interest of the public to have the information in the public domain (after the 'limited time') and the interest of the creator (during the limited time). Also, it's at inventor's discretion. Shredded wheat was patented; the patent holder benefitted, and now everyone can make it. Coca Cola is not; they rely on a trade secret. If it can be successfully reverse engineered, it's fair game.
