Well first you have to have a sensitivity to diacetyl (which is used in the flavoring) AND you have to be willing to develop an irreversible condition whereby you have trouble exhaling.
And, you may not get the money because the defendants (popcorn manufacturer and supermarket) are appealing the decision based on the suggestion that your condition might actually be from carpet cleaning chemicals. But other than that, good luck, more power to you!

Hawaii? No. Too much humidity. Arizona maybe. And even then, that will only partially alliveate (sp) the situation.
You will have that condition for the rest of your life. AND you don't have the money yet because the defendants are appealing claiming it was your job with carpet cleaning chemicals that caused the condition. (BTW, they don't use that chemical in popcorn flavoring any more.)

First you have to like microwave popcorn. I do not like microwave popcorn nor do I like "Movie Theatre" popcorn. Both don't taste natural to me, although I do like the smell of them. I have an old fashioned hand crank, top of the stove (or fire) popper and I only use real dairy butter and sea salt.
I think the lawsuit will go nowhere because it would be very difficult to prove that it was the popcorn and not something else that caused the illness. Then again, when a lady can sue and win for being clumsy and burning herself with hot coffee, anything is possible (did she order iced coffee?). Iven

She had third degree burns on her legs. The cup was shown to be insufficiently constructed.

The coffee was served at a temperature nearly boiling. McDonald's apologized and changed their practices, after having fought the claim with all their might.

Which was substantially higher than the industry standard; in other words, a reasonable person could expect to get burned from hot coffee; but a reasonable person would not expect to get severe third degree burns requiring hospitalization. They also had a good deal of information available to them about injuries suffered by other coffee drinkers which was related to their temperature (20-30 degrees higher than most places, as I recall), and chose to ignore it. They also refused to pay her very modest hospital bills, offering only $800 (her bills were about $10,000). She was willing to walk away from the whole thing if she wasn't out-of-pocket for her injuries.

Actually, I was unaware of most of the precise details of the story until now: On February 27, 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered a 49-cent cup of coffee from the drive-through window of a local McDonald's restaurant located at 5001 Gibson Boulevard S.E. Liebeck was in the passenger's seat of her grandson's Ford Probe, and her grandson Chris parked the car so that Liebeck could add cream and sugar to her coffee. Liebeck placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap.[11] Liebeck was wearing cotton sweatpants; they absorbed the coffee and held it against her skin, scalding her thighs, buttocks, and groin.[12] Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns on six percent of her skin and lesser burns over sixteen percent.[13] She remained in the hospital for eight days while she underwent skin grafting. During this period, Liebeck lost 20 pounds (9 kg, nearly 20% of her body weight), reducing her down to 83 pounds (38 kg).[14] Two years of medical treatment followed. [D]ocuments obtained from McDonald's showed that from 1982 to 1992 the company had received more than 700 reports of people burned by McDonald's coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000.[6] McDonald's quality control manager, Christopher Appleton, testified that this number of injuries was insufficient to cause the company to evaluate its practices. He argued that all foods hotter than 130 °F (54 °C) constituted a burn hazard, and that restaurants had more pressing dangers to warn about. What is with the sprint for the hottest of everything? I do not really want to wait 15 minutes for my coffee to cool down. I also don't want to have an accident caused by scalding hot coffee channeled to my lips by that inane lid. We also have a pizza company in central Ohio whose cause to salute is "sizzling hot pizza". Yep, that is just what I want falling on my lap at 50 mph!
