GWB has already taken care of this. A provision of the Patriot Act shields all American citizens from prosecution for war crimes by other nations and the ICCJ.
One of the last living 10-in-one performers. I wanted to be in show business the worst way, and that was it.

In her lawsuit, Saleh alleges that:
-- Richard Cheney, Donald Rumsfeld and Paul Wolfowitz began planning the Iraq War in 1998 through their involvement with the “Project for the New American Century,” a Washington DC non-profit that advocated for the military overthrow of Saddam Hussein. -- Once they came to power, Saleh alleges that Cheney, Rumsfeld and Wolfowitz convinced other Bush officials to invade Iraq by using 9/11 as an excuse to mislead and scare the American public into supporting a war. Was that not before the Patriot Act came in and if so does the provision you mention count?

I hesitate to jump in to this thread, but... why not. Note a few things:
1. Saleh's lawsuit is a civil suit. It's not a war crimes case. Saleh is attempting to obtain money for harms she claims to have suffered. 2. There is a long-established and completely uncontroversial doctrine in American law (... going back to English common law, even) that says that governmental employees, agents, or officials are immune from civil liability for any harms that putatively result from their actions, as long as those actions were in their official capacity. That's not to say it's impossible for people to recover from certain harms they suffer at the hands of the government: it's a procedural thing. The point is that the individuals aren't the appropriate defendants; the government itself is the appropriate defendant. 3. This makes sense. Otherwise, anyone who is unhappy with any governmental action (like if they get a parking ticket, or they lose a lawsuit) would go ahead and sue the individual responsible. In turn, it would be costly for everyone involved -- the individual meter maids, and the courts having to hear these "follow-on" disputes -- and the judicial system grinds to a halt. 4. Hell, even WITH procedural immunity, people often go ahead and sue the government officials in their individual capacities. In law school, I interned with the Trial Division in the Mass. Attorney General's office. We had a complaint that was impressively remote: a convict was suing the individuals in the Board of Bar Overseers (the folks responsible for lawyer discipline), for failure to disbar the judge that presided over his criminal trial, pursuant to the convict's complaint. 5. Back to Saleh and her complaint, justice is not being kept from her. She can have her complaint heard on their merits after substituting the U.S. as the defendant, and not the individuals. In a civil suit, all there is at stake is money. That's not to suggest that justice can always be perfectly served by writing a check. But to the extent that justice can be so served, it doesn't matter if the check comes from the U.S. Treasury or elsewhere. |
