I just wanted to post this in case someone (however extremely unlikely) was wondering where I went. And this is for those who thought I came here to take a few tips and leave. Recently I have came up with two very good ideas for games and I have spent almost all my days developing them. I'm learning how to program as fast as I can! I've started with this prospect that helps you visually wright code, and I have been developing these two games like crazy!

I hope you have license rights for your Harry Potter game or expect a big lawsuit if it ever becomes popular enough to get noticed!

I agree with rockwall. You might want to consider changing the name to "Wand Wars" or somthing along those line that hasn't already been copyrighted or trademarked.

You'd be surprised. Lawyers these days have feelers out on the Internet looking for word usage. (Fanfiction falls under "fair use" clause)
If they got a trigger on a game with "Harry Potter" in the title, they'd be after you with a "cease and desist" in a hot New York minute!

You'd be surprised. Disney sued a nursery school not too many years back for paining disney characters on their walls. Money does not have to be involved for their to be a law suit. |

I'm a patent lawyer. In the past, I've done a bit of trademark enforcement for big companies.
As others have noted, it has nothing to do with making or not making money. If you use "Harry Potter" in a game, you can expect a cease and desist letter eventually. And, to be sure, it's not because the folks who own the "Harry Potter" trademark are mean. They have a legitimate interest in protecting their brand, and when independent folks make unlicensed "Harry Potter" stuff, it arguably dilutes the brand. |
