And if you are paying royalties or the venue you are performing in is paying the royalties then you are totally alright to be using the music....

Furthermore....there are plenty of threads here at the Café dealing with how licensing works.

You are an iddiot. just my personal opinion. The snowanimator is one of the most emotionally touching pieces of magic you can perform and the reason for the stool and price is you are paying for the prop the case the routine. the years of development. And I think 2000$ is a fari price to pay for such an awesome piece of magic. if you don't want to spend 2000 you can still buy a real KJ snow animator by finding a used one I believe the older stools are going for half price like on Magic auction. but if you wanna rip it off go ahead but that is all you are. A rip off. and a hack

This is a typical post from a fellow who doesn't believe that the originator of an effect should get what is coming to him for producing it.

johnny, I can only hope that one day you will originate something, and you will sit by in anger while everyone knocks it off. In fact, here's what I'm going to do. I'll watch for your first product. I'll send it to the boys in Vegas who specialize in that kind of thing, and encourage them to make it for a tenth of the price you are selling it for.

Then, while you are downloading software from Warez, and pulling music off the web with various theft programs, you can whine, because you are going broke.

Most of us don't have to, because we don't work in venues that are covered by individual payments. If you are doing a show at a school or a church, you are exempt. If you are doing a show in a night club or other venue where there is an agreement with ASCAP or BMI, they are paying the royalties, UNLESS, the music you are using is not covered by their agreement. Some European music is licensed through SESAC.

What little music I use is either original or in the public domain.

If I were going to use the snow animator, I would probably use something from The Nutcracker, which I would sequence on a MIDI program.

In Canada, you don't pay royalties, you pay for a SOCAN licence if the venue you are performing in doesn't have one already to cover you. Most theatres and clubs already have the licence, but you would be foolish to perform without it, unless your act has all royalty free music.

I don't believe the people at SOCAN are out hunting magicians, but they prosecute if they are tipped off that you are using music without paying. Their bureaucracy is also quite large. I have had to send them copies of my licences in the past (each venue needs a separate licence when required) because they still send a bill. Without it, you pay a fee and a percentage of the door, not to mention face the possibility of charges. IMO you are being foolish (not to mention a thief) if you do not pay.

I owned KJ's stool and it was a fantastic way to close my shows. I'm just sorry that I sold it. Sometimes even I make mistakes....Sure wish I still had that baby!Magically,
