Question - you purchase a DVD of a magic trick which gives you performance rights. It does NOT say anything about "TV rights reserved." Can you perform it on TV without specifically asking permission?

Note - I'd likely ask permission anyway just to be safe, but I wonder what the consensus is...

A well-known creator/performer told me to just perform it without asking. He said it was understood you get rights when you purchase it INCLUDING TV rights umnless otherwise specified. Agree with that? (No, I won't name him...just to be safe...hehe)

Matt,

Even though I never presented a magic trick on TV yet, I wouldn't perform this purchased trick on TV even though nothing special is stated about TV performing rights.

Personally I would ask the creator for permission to make sure I don't hurt any barriers.

Result : It makes you feel good because you respect the creator and the ethics in magic business. And you will wonder how many creators might actually say : "Yes, go on guy, do it. It's not a problem !"

This kind of situation makes me remember a similar one, where I had an idea to vary the Cardiographic Trick from Martin Lewis. Before I started to build the prop I send an e-mail to Martin Lewis asking him for permission to alter the effect using something different than a card. He aswered me straight on that I got his permission, as long as I don't want to make it commercially available to others and that he really appreciated the fact that I asked him beforehands. He was very happy to see that some folks in magic still believe in ethics and the respect of creators and other people in magic.

My take exactly. Never hurts to ask. If they say "no" (which hasn't happened to me yet) then there's a LOT of other magic out there. Smile
