This morning I was watching "T.V. Church".
The pastor told of a story of a man on death row, that refused a Governors pardon. The case went all the way to the supreme court. The decision (from http://members.core.com/~lpm8998/man_who_refused.htm_: ""A pardon is an act of grace, proceeding from the power entrusted with the execution of the laws, which exempts the individual, on whom it is bestowed, from the punishment the law inflicts for a crime he has committed... "A pardon is a deed, to the validity of which delivery is essential; and delivery is not completed without acceptance. It may then be rejected by the person to whom it is tendered; and if it be rejected, we have discovered no power in a court to force it on him. "It may be supposed that no being condemned to death would reject a pardon, but the rule must be the same in capital cases and in misdemeanors." In other words, George Wilson committed a crime. He was tried and found guilty. He was sentenced to be executed. A presidential decree granted him a full pardon. But George Wilson chose rather to refuse that pardon. The courts concluded that the pardon could not be forced upon him.' Our Eternal gift of forgiveness ---- has to be accepted. I am grateful for that gift. Love Brother Harris

It appears as though a pardon can even be granted against the will of the grantee. Originally, however, a pardon could be refused. In the case of US v Wilson (32 US 150) the Supreme Court stated that a pardon is like a gift that can be refused, upholding the notion in Burdick v US (236 US 79).
Then began a reversal of the so-called "acceptance doctrine" in Biddle v Perovich (274 US 480) when it declared that the commutation of a death sentence to a life sentence could not be refused: "A pardon in our days is not a private act of grace from an individual happening to possess power. It is a part of the Constitutional scheme. When granted it is the determination of theultimate authority that the public welfare will be better served by inflicting less than what the judgment fixed." President Calvin Coolidge, in an unadjudicated case, pardoned a prisoner named Craig, and when he refused the pardon, ordered him removed from the prison and "the doors locked behindhim." |

May our God pardon us and forgive us for retaining the death penalty for it removes all possibility of redemption and it makes us murderers. May He enlighten us that vengeance is ONLY His. Murder is murder whether committed by the individual or the State. God marked Cain so that he would no be murdered and God Incarnate stopped an execution. We executed our God and He rose again.
