Ya I was broken into but called my local coin guy to see if anyone came in to pawn any coins or jewlery and BINGO , he got ids and prints from the guy that sold it to him. Hopefully the sheriff will have these guys in custody today.

Now I find out that Florida law says pawn shops have the right to charge you what they paid to get your stuff back. so here we go , victom twice in two days.

"Are you knowingly/willing holding known stolen property ransom / hostage?".
I am blown away that a business can operate & pay taxes, while not being held to the same laws a person would, when there is clearly a crime taking place. Hope they ripped off the robber at least! (A thief thieving a thief?... I notice most pawn shops don't 'prey on the rich', so to say...) |

I got curious and started Googling....
See the last part -- it says you have to file a claim, but says NOTHING about the rightful owner paying the pawn broker. There is a clause for someone convicted of selling "misappropriated" goods to have to reimburse the pawn broker, but not the theft victim. This was just a quick look, IANAL -- again, check with the police, or if you have or know an attorney... At a minimum I would ask the pawn shop to provide a citation for the law that says you have to pay them. If they can't, I'd point them to the clause below showing they'll have to pay your costs if it goes to court and they lose, and they should _know_ they'll lose. I smell someone trying to BS you to cover their losses. Separately, do you have insurance that would cover the theft? Another approach might be to file an insurance claim and let the insurance company and their lawyers go after the pawn shop to recover their costs. Be careful of that though... sometimes filing such a claim -- of even _inquiring_ about doing so can make your rates go up or even be denied for renewal. http://www.ccso.org/PublicInterest/pawned.cfm Quote:
Florida Courts have ruled that law enforcement may no longer recover stolen property from pawnshops or secondhand dealers and return it to a victim of a crime without providing the broker an opportunity of a hearing. http://www.tampagov.net/dept_police/File......-001.pdf Quote:
as otherwise provided by law. |

I'm sure laws from state to state vary somewhat but I have seen both Pawn Stars and Hardcore Pawn state at one point or another that when they take a stolen item and it comes up as stolen - their loss... Which they go on to explain the reason they sometimes really check first.
Sorry for your loss anyway, hope you get everything back and these a holes get what they deserve. Hope it turns out ok for ya.

In NYC, Pawn Shops have always been pretty seedy places. There's not many of them around anymore (Thank God) and that's a good thing as they have always benefitted upon other people's miseries and losses, as well as helping sometimes to legitimately trade cash for goods. All in all, not a nice place, even on the television shows about the business it shows shady, aggressive characters ready to take advantage of people.
Hope you get your stuff back TWOCAN, and hopefully at no great cost that really adds insult to injury.

That's great that you got 90% back. (I'm sure your coin gaffs weren't the only things that were important to you) I have heard of people losing all photos of loved ones just due to a laptop being stolen. Some things just can't be replaced.

Man great news considering...........
I would think if you filed a claim w/ the police dept. they could go pick up the "evidence" from the Pawn Shop as well as the paperwork and prints and have the stolen goods be returned to it's rightfull owner. db sorry to hear about the loss of your goods and privacy. My parents were robbed when I was a kid. I know the feeling. |

Good to hear you have the majority of your stuff back. I'm still scratching my head over that Florida law...makes no sense to me whatsoever.
Now, if that last 10% could just show up as well ! |
