In New York, and some other states as well, there are two minimum wage rates that prevail: one for non-tipped workers, and a much lower one for tipped workers.

You cannot have a vast army of people living below subsistence level and expect an economy or a country to be healthy.

Penalizing? If you read what I wrote I said the minimum is a floor for other jobs, not a ceiling. If you look at the budget above, you'll see it doesn't include the cost of higher education--neither tuition nor student loan debt."Choosing to better yourself" only becomes a choice when you have the resources to do so. Otherwise, there's not much of a choice.
