It's interesting that the court seemed to confirm that Ivey wasn't cheating by actually edge sorting, but was guilty of cheating by engaging the innocent croupier, without his knowledge, in the act of gaining an advantage over the casino.
All still very murky, but the court seemed to state that the specific act of edge sorting itself wasn't cheating, only the process that surrounded it. Did anybody else read it that way? - or am I off base? |

It seems the judges are not really sure of how to interpret the law a' "Four judges have looked at this issue now and none of them have been able to agree on the correct interpretation of section 42 of the Gambling Act." Therefore, "It is essential that the law is clarified and, in light of today's decision, we are seeking permission to appeal to the supreme court."
However, the bottom line is: when in doubt rule in favor of Crockfords??? Can anyone say "honest cheating" with a straight face??? I tried in front of a mirror and cannot do it. Hopefully, the Supreme Court can come to a clearer decision on this. However, my non-legal view is Ivey and Cheung Yin Sun used deceit (grift and con) to accomplish their objective, which to me in and of itself is not cheating but...having an unknowing dealer rotate the cards to their advantage walks a very thin line. Is that any different than the teams that played this gaff in BJ, years before Ivey was born, and rotated the cards themselves on the table. I really don't know. Rotating the cards, directly or indirectly, is the problem area here from what I can see. But once again, it really doesn't matter what we think or how we interpret it. It is the court's decision on the matter which will determine whether or not Ivey and Cheung Yin Sun get the money and which sets a precedent on future decisions of this nature.
