I am furious that this booklet, which I paid a lot of money for, is being actively pirated on the internet. The booklets were digitally watermarked to identify each individual purchaser in the event of illegal distribution. The person linked to the illegal copies is soon to be named and shamed. The community will be shocked.

This is the reason why it is necessary to keep a record in case of resale or even to inform the creator of our resale.

I performed this for an audience of about 200 adults at a holiday party, and received a standing ovation at the end of the show. This is a KEEPER.

Not touching upon the sensitive topics of ETHICS on exposure/piracy, I would say:- This is a NEW WORLD of information technology and one WILL have to and should learn to live with it. Magic exposure/piracy is a very small field. There is billions of dollars at stake in the computer software, movie and music industry the world over. Who has the time & who cares about magic exposure/piracy. This is a FACT whether one likes it or not. Magic pirates (in general term I will call them software pirates) will always have an upper hand no matter what you do. Whether one likes it or not we have to live with this menace - One has no choice. Checkout those China Magic sites flourishing on YOUR intellectual property. But the question is – Can one do anything? And the answer is a big ’NO’. Sell your product if YOU think it is worthwhile & profitable keeping in mind the various factors. Make hay while the grass is green. On the subject you will find numerous lengthy topics here on the Café which were started and then died their own natural death without achieving much. I am sorry incase I have been harsh on the subject, specially to the creators of new magic. I am NOT getting into a debate on this. I have said what I had to. This is my very personal opinion. Thank you and continue please . . . P.S. Quote:

The person is now at liberty to sell (at a profit or at a loss) or gift the ORIGINAL item to anybody he so wishes. One cannot impose any condition/restrictions on the re-sale of a legitimately purchased item. Hence I see no reason for informing or taking permission of the creator. If any such conditions are imposed by the creator, it is only to inculcate a false sense of security into the minds of the creator and used only as a deterrent, NOT for the PIRATES, but for the simple, genuine & honest BUYER. This clearly amounts to threatening the Genuine BUYER so as to become an hindrance/nuisance for him from re-selling the legitimately purchased magic item in times of urgent need. Just MY thoughts please. And like I always say - Continue please . . . .

Well said Usataad. Anyway, you can't make people inform the creator if they resell an item. Buyers have rights, legal rights. Punishing the honest people because of what dishonest people do is ridiculous.

Think the point has been missed
What Dreda means is..... When the person is named Who we will all be shocked to learn who it is... They will say, 'wasn't me, I sold it to some bloke in the pub' If this had been told to the creator before they found out - it would have been more believable. Interesting point though - if a creator limits a release... that makes it easier to read it/learn it - and then get a higher price [the same you paid for it or more] by selling it... so a limited release sort of encourages customers to sell the item by making the item more scarce Anyway - I suggested to another magician, rather than outing the person... they should sell their next item to them... but then send them a blank PDF When they complain - explain why... Be interesting to hear who may have done this But I would fully expect them to either have sold it on, or say they have... The moral of the story [?] If you are going to do this... tell the creator you sold it to someone [even if you haven't] before you do... I believe there are some sites that are exclusive maybe 200 members ... who all exchange magic peer to peer If this person is guilty they are probably on there and it's the done thing to give 'teh community' some stuff - as you fair share Happy theif hunting |

Oh and the magician [famous mentalist] I discussed this with [after it happened days after he had a big booklet released)... well I said it's ironic, that to catch the person - the creator themselves, have to pay money to the pirates to get a copy of their own pirated work

Sorry to spam this thread
But I'm shocked it sold for $60 + $22 on eBay https://www.ebay.com/itm/Ten-Card-Miracl......28994115 When it actually hasn't sold out [new] for $50 It's shcoking that 200 copies haven't even been sold yet |

Thus the honest man is one and only - The Creator. The rest of his clients are all dishonest people until they so prove otherwise over a long period of time. This, IMO, is ridiculous, an utterly ridiculous sales tactics. In this particular case, the so called 'Limited Edition' offering of this very exclusive release has been made in the open section of the Café thus making it feasible for any Tom, Dick & Harry to purchase the item and put it on sale on any pirate site. The creator can then name that insignificant buyer but not before the 200 copies have turned into 2000 copies and the whole purpose of exclusivity is lost, lost forever. WE, the creators, need to be honest to our own self and have faith & trust in our clients.

IMO If you're going to go through this watermarked business to try and prevent unauthorized publication and usage, then the creator needs to create a website for sellers to log onto for the specific purpose of transferring the license to another party if they elect to sell the item. So essentially, when you make the purchase you are also agreeing to forward the contact details (name, email, and phone #)of the person you're selling the item to on a dedicated website as a "condition of purchase". Of course, this is making a big assumption that people will not only remember to do this but are also willing. Because this borders on a violation of the new buyers privacy. Either way, this is a sticky situation.

So I buy it off X
We are both on the website Ted sets up Then it gets pirated Err... who gets the blame Both of us [?] Only way it works is if you say 'no sell on' - even then it won't work |

I don't think they are marked at all. Its simply a tactic to scare pirates. So, there is nothing that can be done. I paid $200 + shipping to India via fedex for his last book and it got leaked too. But I am not too worried since those who do this kind of thing do so only to 'collect' secrets. They certainly don't have the patience or skill to perform it.

Well
If they do NOT unmask the person who did it - then there is no deterent anyway, and no point in putting the mark in If they want to buy something else and you refuse to sell anything to them - they can get someone else to buy it |

This is such a tricky situation because it borders on trying to control people's actions after they've made the purchase. Plus, there's always a question about whether a limited release is truly "limited". On my booklet it did not have any info like #29 of 200 with a tracking # or such. It's a tough/gray area. And I don't mean this post to be specific to Ted's releases. This is true of all limited releases. A few items such as the Grismer Lock did indicate the number right on the carton. But I find this to be more of an exception than the norm. I also remember buying Looch's "AREA" book test and he specified in the instructions to contact him first if you were planning to sell. Only Looch can say for sure whether the tactic worked but I doubt that more than a handful followed his instructions.

Back in your box Nicolina, as I said it's not for me to reveal the person involved. That's for Ted to decide not me.
