Thanks for the suggestions. I think we will follow up on a few of those. Good Ideas. Kyle- I wish I could tell you this is all a joke, but it is absolutely real. Remember this is California. It is the job of government here to tax, fine, impose regulations and generally screw up all business as much as they possibly can. Our state has recently been vote the worst climate for doing business in the country. Hopefully Governor Arnold can help pull us out of the mess that the last Governor and all his buddies in local government around our state has put us in. I don't expect much. You need a license to hold a yard sale in San Antonio, too. I honestly don't think that ordinance is enforced much.
But this case is absolutely insane, Brady and Stone! You absolutely should bring it to the attention of very media outlet you can..., and hey, it's PR for you guys at the same time. I would absolutely file lawsuits against the sheriff, the sheriff's department, and the city. And file complaints with the proper state agencies. Cover them in so much red tape and legal paperwork that their great-grandkids'll be sorting it out (yeah, I'm in my revenge mode, but so what. These creeps deserve it!) See ya! Joe L.

In Australia the police operate on a national and state level (i.e. no local polic force). This means that whilst local councils can pass all sorts of wacky ordinances, they don't have immediate access to the police to enforce them.
They tend to send letters! So, my advice to you....move to Australia! |

That's probably the most troubling aspect of this entire incident -- that the City of ___________ could have achieved the same result (our getting a business license) with a simple letter. Instead, at my estimate, they've spent around $2K. But we were a couple of maverick Magicians, eager to make our mark on the Southern California Magic scene. And so begins a sordid tale, one of squandered public resources and misplaced official zeal. In the end, there would be a body. Brady & I had begun the year with an article in the local paper featuring our ‘psychic Magic performances.’ A week later, we were hired by the sheriff’s station in a local town; on 28 January we showed up for the gig. Three large sheriffs wearing sidearms and flak jackets escorted us to an interrogation room, where we were told that there was no gig. Instead, a business license application was shoved across the table at us, and then we got a misdemeanor citation for conducting business without a license. It would take four trips to court before justice was served. Two different judges laughed at the case, one city prosecutor wouldn’t even give us his card when he told us to cut a deal with his boss, and the grand total received in fines received by this law-abiding town was a hundred bucks. Maybe it was worth it to the citizens of that town. After all, you won’t catch us doing unlicensed Magic there. But maybe the citizens of that town would have preferred that its sheriffs hadn’t been paying so much attention to a couple of Outlaw Magicians. You see, on January 28th, 2004 -- the very same day we were stung -- a murder victim was found in that town. To the best of my knowledge, that murderer’s still at large. Yeah, it looks like entrapment to me. Unfortunately, as our species discovered during an early incident involving a sly serpent, a tempting fruit, and a clear prohibition against certain actions, "He/she/it enticed me to __________ " doesn't carry a whole lot of weight as a legal defense!

If you're gonna send a press release to the big guys, you should actually name the town. It sounds a bit made up otherwise. And get a good headline. "A Tale Of Outlaw Magicians" doesn't say much. Hope you win this one man. Robert Bloor

No, we didn't get a deposit. However, being something of an Educated Donkey, on the way out of the interrogation room I couldn't resist asking one of the deputies: "Let me clarify -- there's no gig, and we're not getting paid?" They pretty much failed to see the humuor. However, the last laugh might be Brady & Stone's. I sent a copy of the latest version of the press release to the Associated Press yesterday. Their Orange County representative called and expressed interest. We'll see! Leland |

This is mind-blowing. I've heard of law enforcement using false promises of lottery winnings to lure felons who are on the lam... but practicing magic without a license??? These are deputies in dire need of a hobby.
By the way, it's not entrapment. Entrapment is when you entice someone to commit a crime and then bust them for it. They enticed you to their station for something they felt you did already. Avi |

But, remember, he said he has never performed in that town before. Therefore, there was no previous crime committed in that town until he was booked for the show. |

It is absolutely entrapment. They enticed them to come to their town to perform illegally. I grew up in Whittier which is next door so to speak and Norwalk County Sheriff's are notorious their bullying tactics.
Why are the county sheriffs enforcing city law in the first place? Does La Mirada have a city police force? If so, there may be a jurisdiction issue in addition to the entrapment. Good luck. I hope you get a lot of free publicity, an apology and your performance fee. |

Have you checked in with your local PD, by the way? They'll almost certainly have somebody in charge of Community Relations. Maybe just drop by, tell them the story, maybe do a couple tricks - let them know you're on the right side. Most cops (generalizing here) don't care for those sort of antics, if only because they're aware it makes law enforcement look bad.
