After I get the guys license plate I exit the freeway and call 911. A state trooper arrived and told me it was my fault without looking at the video. Later I noticed she has false information on the accident report. I show the video to her Sgt and Lt. They tell me it was the driver of the black truck's fault for speeding and they called it a hit and run. The state trooper is mad at me for going up the chain of command. I met with her again a week later and showed her the video. She glanced at it and said it is still my fault and writes me up a ticket. I am going to write up the state trooper and send the complaint to the capitol.
There is a speed limit sign in the construction area on the side of the road reading "60" for the speed limit. The guy was driving in his seventies. And a warning merge sign is on the road for him. He ignores it. |

Black truck had the right of way. You have to merge from the on-ramp. Sorry.

This was totally avoidable. It is why many police departments stopped referring to them as "accidents" and call them "incidents" or "crashes". Mike this just might not be worth complaining about if you drive these roads regular. I'm sorry your car is damaged. That blows. You just might not be able to win that case.

Two things come to mind,
if he was going 10plus over the speed limit, so was everyone else, he was going the same speed as the jeep next to him. you seemed to be going a little slower based on the first cars that went by, You're supposed to match the flow of traffic. Second, the guy in the truck had an empty lane next to him and got hit anyway. |

I don’t see how Mike could win the case. The main road always has the right of way, those coming into it must slow and wait or just stop. I'm not sure the black truck could get over into the left lane because of the oncoming jeep. I also think the jeep saw what was about to happen and then speeded up to get on out of the way.

To make my position clear: irrespective of who has the right of way, the driver of the truck had a much better view of Mike's vehicle than Mike had of the truck. Avoiding a collision (incident, crash, accident, whatever) is everyone's responsibility, but, in my humble opinion, the driver with the best view of the potential for the collision has the greatest responsibility, the level of responsibility decreasing for each person who has a worse view.
The truck driver was (or, at least, should have been) aware that Mike's lane was merging with his. Where, exactly, did he expect Mike to go? Numbskull. |

Bill he may not have had such a great view. That spot in a truck is indeed blind. Mike has a fantastic view as he was merging and simply had to tap the breaks. Listen to his car rev. He is trying to get in front of the guy when the correct and safe play is to go in behind him.
Numbskull? Oh yea the truck driver qualifies without doubt. The guy was clearly trying to make it so he was in front. He ended up going so fast he hit the brakes to get to a normal speed. He most likely saw Mike. He was willing to risk lives to simply be in front of another driver. (Then again so was Mike.) The issue I have with these situations is too often they end up affecting others. Others gets caught up in the twisted metal and plastic when they go very wrong. Couple of guys not wanting the other to be in front of them and suddenly a 7 year old ends up in a coma. Ego battles in vehicles are beyond numbskull if you ask me. Just let the guy in or just get behind the numbskull. It isn’t tough. I mean even if everything went to plan what would you have gained? Being one car in front of a numbskull on the highway? Totally avoidable by everyone. But as for Who woods prevail in court it is the truck guy.

Danny: did you do much traffic enforcement in Chicago?
If so, you probably saw a lot of this sort of stupidity. Maybe not on the highways (is that the domain of the Illinois State Police?), but certainly on the streets. |

Lord yes. (Suburb of Chicago. We had a spot where two different three lane roads in each direction, intersected then went down to two in each direction. 55 mph speed limits. Man it was stupid what some will do to be just one car in front!
The vast majority of any uniform cop work is traffic. Certainly at first. You see this nonsense all the time with ego crap. Then it becomes road rage. But like I said the good thing is only the two egos involved here were affected. As I said too often there is collateral damage and innocent property or worse yet people get hurt and hurt seriously.

Well said Bill. I totally agree with you.
This was not normal driving in regular traffic lanes. There is construction taking place. The driver of the black truck was wrong in several ways: 1. He did not have on his signal light as he switched from the second lane to the first lane. 2. He was going over the 60 mph speed limit listed in the construction area. 3. He ignored the "slow merging traffic sign" listed in the video. 4. He did "hit and run." 5. He was careless/reckless driving. 6. He was in the fast lane at first. I was always in the slower traffic lane. On the trooper's report she list she went over to the driver of the black truck's house and he never answered the door. Most likely he was driving drunk and never wanted the trooper to see him the way he was. I followed him after the accident/incident two miles as I was speaking with dispatch giving his license plate. He was driving in the seventies in the 60 mph construction area. He did not even turn on his signal light as he exit the highway. When he was against my vehicle making contact I did not want to stop because someone else could have been behind me. That would have made a big impact. If there was no construction the merge lane would have been longer giving me more time and space to stay to the right side. But it was short. That is why the special slow merging traffic sign was up. I also agree with the state trooper Sergeant and Lieutenant who saw the video and told me it was the driver of the black truck's fault for speeding. The state trooper looks young. When I went to the state trooper post to show her the video I heard she will call me that night. She did not call me that week. I went again to the post the next week. I heard she will call me, but not the first 5 hours of her work time because she will be in training. I can't wait to see the state trooper's face when I win in court. |

My lord you’re not going to win. See here is what you miss. Even if he did all those things wrong you were still in the wrong for the incident. Him being “wrong” according to you, means nothing. You still were supposed to merge behind him.
And if he was doing 70, how fast were you going to catch up to him? You had to be doing quite a bit faster. He indeed did hit and run. This much is obvious. This is indeed a ticketing offense without doubt. But all the other things you list simply are your opinion and as such worthless in court. Hopefully this guy gets nailed hard for hit and run. He should have stopped. He has no excuse.

Hey Mike, could you give the time stamp in the video of where you first became aware of the truck? And how close to you was he at that time? Also, was there a vehicle behind you on the merge ramp?
Both Bill and Danny make good points. Personally, whether I'm the "merger" or "mergee" I never assume the other guy will defer to me. If in doubt, I always slow down. That being said, these things can happen despite our best intentions. Anyway, I'm glad nobody was hurt.

I’m glad nobody was hurt, and Mike is lucky that the black truck wasn’t an 18-wheeler. But I still say the main highway traffic has all the legal/road rights on their side, and I can’t see a judge siding with any vehicle merging onto it.

Which Detroit expressway was this? Some of these interstates, even though under construction, people are traveling 15-20 mph over posted limit.
Mike, just be glad that the truck did not slow down and be part of the trend that has been happening lately on 94. |

For those that are not familiar with where Dynamike was driving...
Detroit Driving Tips 1. First, you must learn to pronounce the city name. It's Di-troit. NOT DEE-troit. If you pronounce it DEE-Troit then we will assume you are from Toledo. 2. Forget the traffic rules you learned elsewhere. Detroit has its own version of traffic rules... Hold on and pray. 3. The morning rush hour is from 6:00am to 10:00am. The evening rush hour is from 3:00pm to 7:00pm. Friday's rush hour starts Thursday morning. Weekends are open game. 4. If you actually stop at a yellow light, you will be rear-ended, cussed out and possibly shot. If you're first off the starting line when the light turns green, count to five before going. This will avoid getting in the way of cross-traffic who just ran their yellow light to keep from getting shot. 5. Schoenherr can only be properly pronounced by a native of the Detroit metro area. That goes for Gratiot too. Schoenherr is pronounced SHAY NER. Gratiot is pronounced, GRASH IT. 6. Construction and renovation on I-94, I-96, I-75, I-275, I-375, The Lodge and Southfield freeways are a way of life. Just deal with it. There are two seasons in Detroit; winter and construction. 7. If someone actually has their turn signal on, it is probably a factory defect or they are from out of town. 8. All old men with white hair wearing a hat have total right-of-way. 9. The minimum acceptable speed on I-696 is 85 regardless of the posted speeds. Anything less is considered downright sissy. Don't even think of allowing more than one car length between cars. 10. That attractive wrought iron on the windows and doors in Detroit is not ornamental. DO NOT get out of your car. 11. Never stare at the driver of the car with the bumper sticker that says "Keep honking, I'm reloading." 12. If you are in the left lane, and only going 70 in a 60 mph zone, people are not waving because they are so friendly in Detroit. I would suggest you duck. 13. I-275 / I-696 is our daily version of NASCAR. 14. It's not M-10, it's "The Lodge". 15. That's not a lake, it's a pothole. 16. If someone tells you it's on Outer Drive, you better have a map. 17. The left turn is simple. If you want to turn left, go a 1/4 of a mile past your turn, get to the left, then make a left, then make a right. Now you have gone left. Sidenotes: 6 mile turns into McNichols 8 mile turns into Baseline and Vernier at opposite ends 15 mile turns into Maple. 16 mile turns into Big Beaver and becomes Metro Parkway, then Quarton, somewhere along the way. 17 mile turns into Wattles 18 mile turns into Long Lake 19 mile turns into Square Lake 20 mile turns into Hall Road and then Highland Rd., before it becomes M-59 Main street starts as "Main Street" and turns into Livernois for no apparent reason. If someone tells you to take "75 South to Detroit" make sure you merge onto 375 or you'll end up in Toledo. |

Anytime you pull into a main road from an access road (or ramp) you are responsible. That is the law. This happened to me, I was not speeding like the guy in the truck but a girl pulled out from an access road into me. We took it to court and it was over quickly, the judge said, "The law states that the responsibility lies with the vehicle pulling onto the main road from an access road." Judgement for the Plaintiff, me.

Regardless of who has the right of way, the code of the road is to always give way if it can help to avoid a crash.

BOTH parties should have given way. So when two egos clash who refuse to give way, even to the point of dangerous consequences, the law is what decides.
You’re right tommy. If it was me and I was either party I would have slowed down to avoid injury and damage regardless of if I was “right” or not.
