Apparently, there is a new court show called "Judged by Matt Walsh" and a
case on there involves two magicians: https://www.dailywire.com/news/judged-by......ttresses The second half of that article describes the case, the episode itself is behind a paywall. It says that Jason was suing Mark on the grounds that Mark performed a trick that Jason invented at a show they did together. Obviously, I don't have the full story because I haven't seen the episode, but it seems Jason wanted $1000, the amount he paid the videographer, because he felt that Mark performing his trick ruined the footage. He apparently claimed that violated the magician's code. To quote the article: "There's an unwritten rule in the magic community that if several magicians are performing in the same show, if you have the creator of the trick on the show, and then you have someone else on the show who has purchased the trick, the general practice is that the person who purchased the trick will defer to the person who created the trick," the plaintiff explained. That is a very specific clause, although it makes sense, I'm not sure if I have heard that specifically before. Is this a known standard? I don't know the judge's decision, but off hand I would say asking Mark to pay the videographers whole fee is sort of odd. Couldn't the fact they used the same trick be edited around? Mark's defense was that the trick was different enough to be unique. The most notable part of that article was the judge informing Mark of the gravity of the claims leveled against him, he stated: "This is a serious charge. The magician code of conduct is deeply important to each magician. It's all he has because he doesn't have friends or a social life." I thought he was talking to me there. Anyway, what are you folks' thoughts on this topic? I don't know what the judge decided or the details, but I did find the case interesting. |

While I think the "magicians code" isn't as strictly adhered to by magician's today as the judge would like to think, the last sentence is so very true for so many! |
